Terms of Use

These Terms of Use ("Terms") govern your use of the Viraly iOS application (the "App"), operated by Anderson Westfield ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

Your use of the App is also subject to Apple's standard Licensed Application End User License Agreement (EULA). Where these Terms conflict with the Apple EULA, the Apple EULA controls for App Store–related matters.

1. The service

Viraly provides AI-assisted analysis of short-form video content: virality breakdowns of public videos you submit by link, performance analytics for the Instagram account you choose to connect, AI-generated coaching, strategies, scripts, and video discovery. Analysis results, scores, forecasts, and suggestions are automated estimates for educational and informational purposes only — they are not guarantees of performance, reach, audience growth, or income.

You agree not to: use the App for unlawful purposes; attempt to analyze private, infringing, or unlawful content; reverse engineer, resell, or abuse the service (including automated bulk requests); or use outputs to harass or defame others.

5. Third-party platforms

Viraly is an independent product. It is not affiliated with, endorsed by, or sponsored by Instagram, Meta, TikTok, YouTube, Google, or any other platform. Platform names are used only to identify where content originates. Features that depend on third-party platforms or AI providers may change or become unavailable if those services change.

6. Disclaimers and limitation of liability

The App is provided "as is" without warranties of any kind. AI-generated output can be inaccurate or incomplete; verify anything important before relying on it. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill, arising from your use of the App. Our total liability shall not exceed the amount you paid us in the twelve months before the claim.

7. Changes

We may update the App and these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.

8. Termination

You may stop using the App at any time. We may suspend or terminate access for violation of these Terms. Sections 1, 3–6 survive termination.
